Suggested language:

No funds otherwise provided in this bill shall be spent on a contractor which:

1. Has been found during the last five years by a federal inspector general or other auditing or oversight agency to have overcharged or improperly billed the government in total by $10 million or more, through one or more overcharges, or to have committed any fraudulent act or acts against the government resulting in total costs or losses of $10 million or more.

2. Has had rendered against it twice within the last five years a judgment or conviction for offenses which constitute a cause for debarment under the governmentwide debarment system.
